TOS Updated!

Hello precious folk,

Some revolutionary updates were made to the Terms&Conditions of GrowDiaries.

Section 5.B was fully replaced. GrowDiaries has granted the ownership rights of the Content to its users.  Moreover, GrowDiaries has waived the right to display, distribute, or perform copies of your Content that have been removed or deleted.

¨Using Your Content. You retain all of your ownership rights in your Content. However, by submitting Content to GrowDiaries, you hereby grant GrowDiaries a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and GrowDiaries' (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. The above licenses granted by you in Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your Content from the Service. You understand and agree, however, that GrowDiaries may retain, but not display, distribute, or perform, server copies of your Content that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable.¨

NEW Section 5.G was added. Even though we do our best to protect your data, it is important to understand that GrowDiaries cannot fully guarantee confidentiality. Please keep this in mind while working with such a sensitive subject as cannabis. We do remove EXIF data from images and IP's from server logs.

¨As a GrowDiaries account holder you understand that GrowDiaries does not guarantee any confidentiality with respect to any Content you submit.¨

NEW section 5.H was added. Look but don't touch. No Content can be downloaded unless there is a 'DOWNLOAD' button or a similar link displayed.

¨Content is provided to you AS IS. You may access Content for your information and personal use solely as intended through the provided functionality of the Service and as permitted under these TOS. You shall not download any Content unless you see a “download” or similar link displayed by GrowDiaries on the Service for that Content. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of GrowDiaries or the respective licensors of the Content. GrowDiaries and its licensors reserve all rights not expressly granted in and to the Service and the Content.¨

From Wikipedia: Since the Exif tag contains metadata about the photo, it can pose a privacy problem. For example, a photo taken with a GPS-enabled camera can reveal the exact location and time it was taken, and the unique ID number of the device - this is all done by default - often without the user's knowledge. Many users may be unaware that their photos are tagged by default in this manner, or that specialist software may be required to remove the Exif tag before publishing. β€” It would be great if GD were able to remove EXIF tags on upload, but if not, I suggest folks take measures to remove them yourselves. There are apps, and screenshots of your images, I believe, will remove EXIF data. I’m glad GD updated its content policy as I wondered whether its prior incarnation was legally enforceable as an opt in to participate policy that forfeits copyright ownership. Thanks for continuing to make improvements for our small but important community. It must be challenging to manage the legal aspects of running an international site for home cannabis growers.

That's quite a nice move, considering the old rule is basically the norm around, it's quite progressive to drop it. I wonder: what's your standing on Law Enforcement asking you for personnal datas? Also, do you strip pictures of all meta datas? If not, do you plan to? Thank you @growdiaries for the great work.

@Yogsothoth, we do our best to protect your identity and secure your data. It is highly recommended to get familiar with the laws of the country you reside in, as regulations vary tremendously depending on your location. We suggest to take precautions, use Tor browser and VPN. As mentioned in the article, in our turn, we will remove meta data, won’t share any personal information or store IP logs.

Nice to have a clear position, and update on the policy is very nice of you to keep it transparent thru this post. Seen some of my content published by you guys on youtube (Have my own channel & Instagram), but never got mentioned for it. I'd appreciate if you did in future as the seed breeder was given credit for a strain they never grew. Which was a shock. iOS app would also be really handy, as I'm sure there are plenty iOS users and would help you expand your platform @GrowDiaries I'm sure Tor browsers will also protect identities to the highest degree for anyone one who wants that extra safety.
